Terms of Service

1. Agreement to terms

By accessing or using ClubCo (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of service

ClubCo is a software-as-a-service platform providing sports club management tools including membership management, invoicing, event management, and communications. The Service is provided by CodeSense Software (Pty) Ltd.

3. Accounts and subscriptions

You must create an account to use ClubCo. You are responsible for maintaining the security of your account credentials. Subscriptions are offered on a monthly basis and priced in South African Rand (ZAR). You may cancel your subscription at any time with 30 days written notice.

4. Your data

You retain ownership of all data you input into ClubCo. We process that data on your behalf as an operator under POPIA. You are the responsible party for your members' personal information and must ensure you have appropriate authority to input that data. See our Privacy Policy and your Data Processing Agreement for details.

5. Acceptable use

You agree not to use ClubCo to send unsolicited communications (spam), to store data you do not have the right to process, to attempt to circumvent security measures, or for any unlawful purpose.

6. Service availability

We aim to maintain high availability but do not guarantee uninterrupted service. We will provide reasonable advance notice of planned maintenance. Service Level Agreement terms apply to Growth and Club Pro subscribers as specified in their subscription agreement.

7. Limitation of liability

To the extent permitted by South African law, ClubCo's liability to you is limited to the subscription fees paid in the 12 months preceding any claim. We are not liable for indirect, consequential, or punitive damages.

8. Governing law

These terms are governed by the laws of the Republic of South Africa. Disputes shall be subject to the jurisdiction of the South African courts.
